Privacy Policy & Terms of Service

This page applies to the BakerTech website at bakertech.ai and the BakerTech Capture app for iOS and macOS.

In this document, BakerTech, we, us, and our refer to the developer and operator of BakerTech Capture.

Privacy Policy

1) Local-First and Data Not Collected

BakerTech Capture is built on a local-first architecture.

All user-created content, including Seeds, Cubes, text notes, photos, documents, and voice recordings, is stored locally on your device and/or in your private Apple iCloud account via Apple CloudKit when you enable sync.

BakerTech does not operate central servers for storing user content and does not access, inspect, sell, rent, share, or monetize your personal content.

BakerTech does not collect personal data for tracking, advertising, profiling, or data brokerage. This design is intended to maintain Apple App Privacy status as Data Not Collected.

2) Data Processing on Device

Core app features may process your content directly on your device to provide functionality such as capture and organization of Seeds and Cubes, search and indexing, optional reminders, and voice transcription using Apple system frameworks.

This processing is local to your device unless you choose to use iCloud sync.

3) iCloud and CloudKit Sync

If you enable iCloud sync, your content is transmitted and stored through Apple infrastructure associated with your Apple ID.

BakerTech does not control Apple systems and is not responsible for iCloud availability or outages, CloudKit sync delays or failures, Apple account security, storage limits, or account restrictions.

4) Speech Recognition and Transcription Disclaimer

Voice-to-text transcription features rely on automated Apple system frameworks and algorithmic processing.

BakerTech makes no warranty that transcriptions are accurate, complete, or reliable. You are solely responsible for reviewing, editing, and verifying all transcribed text before using it for personal, legal, medical, financial, academic, or professional purposes.

5) Third-Party Web Links and External Content

The app may store and display URLs you choose to save. BakerTech is not responsible for the content, accuracy, security, availability, legality, or privacy practices of third-party websites.

When link previews are generated, your device may directly connect to destination web servers to retrieve metadata such as titles or thumbnails. Those connections are governed by each third party's own terms and privacy policies, not BakerTech's.

6) Security and User Responsibility

You are responsible for device security settings, backup practices, iCloud account configuration and storage management, and access control for your device and Apple account.

No method of storage or transmission is guaranteed to be perfectly secure.

7) Children

BakerTech Capture is not directed to children under 13.

8) Policy Changes

We may update this Privacy Policy at any time. Changes become effective when posted at bakertech.ai/privacy. Continued use after posting constitutes acceptance of the revised policy.

Terms of Service

1) Acceptance of Terms

By accessing bakertech.ai or using BakerTech Capture, you agree to these Terms of Service. If you do not agree, do not use the website or app.

2) License

Subject to these terms, BakerTech grants you a limited, non-exclusive, non-transferable, revocable license to use BakerTech Capture for lawful personal or internal business use.

3) Prohibited Use

You agree not to use the app or website in violation of law or third-party rights, reverse engineer or interfere with platform security controls except where prohibited by law, or use the services to transmit unlawful, infringing, abusive, or malicious content.

4) User Content and Responsibility

You retain ownership of your content. You are solely responsible for the legality, accuracy, and rights associated with any content you save, verifying content and transcriptions before relying on them, and maintaining backups and protecting your account/device access.

5) Speech Transcription Risk Allocation

Transcription output is automated and may contain errors, omissions, or misleading text. You assume all risk for any reliance on transcription output.

6) Third-Party Services and Websites

BakerTech is not liable for third-party services, websites, metadata, content, security incidents, or downtime related to links you save or open.

7) Disclaimer of Warranties

To the maximum extent permitted by law, the website, app, and any related services are provided on an AS IS and AS AVAILABLE basis, without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, or uninterrupted operation.

8) Limitation of Liability

To the maximum extent permitted by law, BakerTech, its developer(s), affiliates, licensors, and service providers will not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including damages for data loss or corruption, missing or altered Seeds, Cubes, notes, files, or transcriptions, failed, delayed, or partial iCloud/CloudKit synchronization, device malfunction, hardware failure, OS behavior, accidental app deletion, business interruption, lost profits, or lost opportunities.

If liability cannot be fully excluded, total aggregate liability is limited to the greater of USD $0 or the amount you paid to BakerTech for the app in the 12 months preceding the event giving rise to the claim.

9) Backup and Storage Responsibility

You are solely responsible for maintaining backups, managing iCloud storage, and ensuring your device and Apple account are configured to meet your continuity and recovery needs.

10) Indemnification

You agree to defend, indemnify, and hold harmless BakerTech, its developer(s), affiliates, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of the website or app, your violation of these terms, your infringement or violation of any third-party rights, or your content, links, or data stored through the app.

11) Termination

We may suspend or terminate access to the website or app at any time, with or without notice, for any lawful reason. Provisions that by nature should survive termination will survive.

12) Governing Law and Venue

These terms and any dispute arising out of or related to them are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. You agree to exclusive jurisdiction and venue in the state or federal courts located in Delaware, except where mandatory law provides otherwise.

13) Modifications

We reserve the right to update or modify these Terms of Service at any time by posting the revised version at bakertech.ai/privacy. Continued use after posting constitutes acceptance of the updated terms.

14) Apple Platform Terms

If you obtained the app through Apple, you acknowledge that these terms are between you and BakerTech, not Apple, Apple has no obligation to provide maintenance or support for the app, and Apple is a third-party beneficiary of these terms and may enforce applicable provisions.

15) Severability and Entire Agreement

If any provision is held unenforceable, the remaining provisions remain in full force. This document constitutes the entire agreement between you and BakerTech regarding the website and app, superseding prior understandings on the same subject.
